General Terms and Conditions

 

§1

ATNK dr Natalia Kuźmienko, hereinafter referred to as the Translator, provides translating and interpreting services in accordance with the terms and conditions specified hereinbelow.


§2
Placement and acceptance of order

  1. To place an order, the order form shall be downloaded from www.atnk.pl/order_now, completed and emailed at . The order form shall bear a company seal and be signed by an authorized person.
  2. The translation work shall commence against the receipt of the client’s written order and the non-refundable advance payment of 30% of the order gross value.
  3. The Translator may decline an order without providing a reason.

§3
Confidentiality

All information and the documents made available by the  client will be treated with utmost confidentiality.

§4
Pricing

  1. The payment for the performed assignment shall be made on the basis of the VAT invoice by a transfer to the bank account specified in the invoice, or by cash.
  2. The Translator is the VAT-tax payer.

§5
Written translations

  1. A non-authenticated translation page shall mean 1500 characters (including spaces). An authenticated (certified) translation page shall mean 1125 characters (including spaces). The final pricing estimate is made on the basis of a ready translation.
  2. Each incomplete page of translation is rounded up to half a page, except for the first page which is counted as a complete page.
  3. Each incomplete page of a non-authenticated translation is always counted as a complete page.
  4. Saturdays, Sundays, statutory holidays and the day of order acceptance are not counted toward translation time.  This being the case, the orders placed on Friday/Saturday for Monday, if they exceed 5 pages, shall be deemed to be urgent or express.
  5. The client may cancel a placed order, however shall be obliged to pay for the translation made by the time of order cancellation, and shall reimburse all costs incurred in connection with the order implementation. The order cancellation shall be made in writing.
  6. The Translator may withdraw – without any consequences – from the order placement no later than 48 hours prior to the commencement thereof.

§6
Translation procedures

  • standard (+0%) – up to 5 pages per day (orders shall be accepted by 1.00 p.m.)
  • urgent (+50%) – 9-10 pages per day or up to 5 pages for the following day
  • express (+100%) - up to 12 pages per day or the next day
  • super express (+150%) – more than 12 pages per day
  • „mission impossible” (+200%) – translation ordered or collected on holidays.

Standard translations, if a delivery time thereof is not set out in the order form, shall be delivered to the client by 5.00 p. m. on the day specified as the day of translation completion, unless the agreement stipulates otherwise.

§7
Interpreting

  1. The interpreter’s attendance time shall be between the start time and the end time, as recorded in the order, and shall cover all breaks (if any), e.g. meal or conference breaks.
  2. Consecutive interpreting is charged on an hour-basis. The minimum consecutive interpreting assignment per day shall be 2 hours.
  3. Simultaneous interpreting is charged on a 4-hour module basis. The minimum simultaneous interpreting assignment per day is a 4-hour module.
  4. The minimum charge for the interpreting outside of Warsaw shall be for 8 hours.
  5. The charge for interpreting on Sundays and holidays or from 10.00 p.m. to 07.00 a.m. will be increased by 100%. The charge for interpreting on Saturdays will be increased by 50%.
  6. In case of out-of-Warsaw assignments, the client shall pay for transportation, meals and accommodation of the interpreter.
  7. The interpreter may request an advance payment of 30% of the gross order value. The payment shall be made on the basis of the VAT invoice by a transfer to the bank account specified in the invoice, or by cash.

§8
Payments

  1. Payments for services will be made under VAT invoices payable within 14 days from the date of the invoice to the bank account specified in the invoice or by cash.
  2. An advance of 30% of the gross value of the order shall be paid obligatorily.
  3. If the invoice payment time-limit has been exceeded by 14 and more days, default interest of 0,5% of the order value will be charged for each day of delay.

§9
Claims 

  1. All claims (if any) shall be raised in writing within 7 days from of the service performed. The raised claim may not affect the invoice payment time-limit.
  2. The Translator will not be liable for the quality of express and super-express translations, or any delay arising from the reasons not attributed thereto, e.g. power cuts, IT server or telephone line failures, post delays, and so on.

§10
Final provisions

  1. Information placed on shall not constitute an offer under the Civil Code.
  2. The Translator reserves the right to amend these Terms and Conditions.
  3. The order placement means that the client has accepted all provisions of these Terms and Conditions.
  4. To the matters not regulated by these Terms and Conditions, the provisions of the Polish Civil Code and the Law on Copyright and Related Rights of 4 February 1994 (Dz.U. No. 24, item 83, as amended) shall apply.
  5. To the matters not regulated herein relevant provisions of Polish law shall apply.
  6. These Terms and Conditions have been made in English, Polish and Russian language versions. In case of any differences between the English, Polish and Russian versions the Polish version shall prevail.
